1. Agreement to Terms

By joining the Tekla Toppings community and using our resources, you're agreeing to the standards we've outlined here. These guidelines help us provide the highest quality training for everyone. If you find you're unable to agree to these terms, we unfortunately won't be able to move forward with providing our career services to you.

2. Description of Services

I provide career training and AI software services as part of the MyProfiles.biz ATS software solution. Accessing our software gives you entry to the career and AI training program alongside our professional tools including resume building, portfolio creation, and ATS optimization. Services include but are not limited to:

• One-on-one career training and implementation sessions
• Resume review, optimization, and creation services
• LinkedIn profile optimization
• Portfolio website creation and support
• Interview preparation and training
• Career workflow and job search support
• Workshops and group training sessions
• Access to career resources and templates

The specific services included in your purchase will be described in your selected plan or package.

3. User Accounts and Responsibilities

When you engage with my services, you agree to:

• Provide accurate, complete, and current information about yourself.
• Be responsible for maintaining the confidentiality of any account credentials.
• Notify me immediately of any unauthorized access or security breach.
• Take responsibility for all activities that occur under your account.

You agree not to share your account credentials with any third party, use another person's account without permission, or use the services for any illegal purpose. You may not resell or commercially exploit my services or content without authorization.

4. Payment Terms

My services are offered at the prices displayed on my website or as communicated to you directly. By purchasing, you agree to pay all fees associated with your selected plan and provide accurate billing information.

All payments are processed securely through Sami Hermes IE 305450179. Payments are currently handled via bank transfer. As additional payment options become available, payments may also be processed through gateways such as Flit or Airwallex. I do not store your full payment card details on my servers.

4.1 Subscription Services

For subscription-based services, your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You may cancel at any time, and your access will continue until the end of your current billing period.

5. Refund Policy

I want you to be satisfied with my services. Please refer to my detailed Refund Policy for complete information on eligibility, timeframes, and the refund process.

6. Scheduling and Session Cancellations

• Rescheduling: You may reschedule a session with at least 24 hours notice without penalty
• Late Cancellation: Cancellations with less than 24 hours notice may result in the session being forfeited or charged
• No-Shows: If you miss a scheduled session without prior notice, the session will be considered completed
• My Cancellations: If I need to cancel or reschedule a session, I will provide as much notice as possible and offer an alternative time

7. Intellectual Property

My Content: All content, materials, templates, frameworks, and methodologies provided through my services remain the intellectual property of Sami Hermes IE 305450179 (operating as Tekla Toppings). You may not reproduce or distribute these materials without express written permission.

Your Content: You retain ownership of your personal information, resumes, and portfolios. By submitting your content, you grant me a limited license to use it solely for the purpose of providing my services to you.

8. Disclaimers and Limitations

8.1 No Guarantee of Employment

While I strive to provide the best career training, I do not guarantee job placement or specific career outcomes. Success depends on many factors including your skills, experience, and personal effort.

8.2 Service Availability

My services are provided on an "as is" and "as available" basis.

8.3 Limitation of Liability

To the fullest extent permitted by law, Sami Hermes IE 305450179 (and the Tekla Toppings brand) shall not be liable for any indirect or incidental damages resulting from your use of my services.

9. Indemnification

You agree to indemnify and hold harmless Sami Hermes IE 305450179, its brand consultants, and agents from and against any claims or expenses arising out of your violation of these Terms or your use of my services.

10. Privacy

Your use of my services is also governed by my Privacy Policy, which describes how I collect, use, and protect your personal information. By using my services, you consent to the practices described in my Privacy Policy.

11. Termination

I may terminate or suspend your access to my services immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use my services will cease immediately. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

12. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the Georgia.

Any disputes arising from these Terms shall first be attempted to be resolved through informal negotiation.

13. Changes to Terms

I reserve the right to modify or replace these Terms at any time. If a revision is material, I will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at my sole discretion. Your continued use of my services after any changes to these Terms constitutes your acceptance of the new Terms.

14. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
